PRIVACY NOTICE IN ACCORDANCE WITH ART. 13 UE REGULATION 2016/679 DATED 27 APRIL 2016
The current legislation on the processing of personal data in accordance with the provisions of EU Regulation 2016/679 dated 27 April 2016 on the protection of individuals (General Regulation on data protection, hereinafter "RGPD") contains provisions for the protection of personal data, with particular regard to the right to protection of personal data, as well as the free circulation of such data (General Data Protection Regulation, hereafter "RGPD") contains provisions in order to ensuring that the processing of personal data is carried out in compliance with the fundamental rights and freedoms of natural persons, with particular reference to the right to the protection of personal data
1.Purpose of processing In fulfillment of the obligations under current legislation, we inform you that FABBRICA D'ARMI PIETRO BERETTA, with registered offices in Gardone Val Trompia (BS) – Via Pietro Beretta n.18, CAP 25063, Data Controller, processes your personal data in order: i) to stipulate the contract, ii) to fulfill the contractual obligations, iii) to perform all activities necessary in order to continuously improve the services provided (Shooting Data application). Furthermore, subject to your specific consent and in compliance with the provisions of current law, the Owner processes your data for the performance of marketing activities such as sales or placement of products and services and the sending of information on the services offered by the company, or related to its activities, or by Beretta Group companies. Lastly, without prejudice to your right to object at any time, FABBRICA D'ARMI PIETRO BERETTA may send you, by e-mail and/or regular mail, promotional information relating to products and services similar to those covered by this contract.
2. Data processing and data retention The processing of data will be carried out, with or without support of electronic tools, according to principles of correctness, lawfulness, transparency, so as to protect at all times the confidentiality and rights of the data subjects in compliance with the provisions of current legislation. Your data will be stored, in accordance with the provisions of current legislation, for a period of time not exceeding that necessary to achieve the purposes for which they are processed. Particularly, in relation to the management of the existing contractual relationship, the data will be kept the time defined by relevant legislation as well as, at the termination of the contractual relationship, for a ten-year term for the preservation of certain data (e.g. accounting data for auditing purposes). In relation to data processing for marketing purposes and in case of explicit consent, the data collected will be kept for the time strictly necessary for the management of the above purposes, according to criteria based on compliance with current regulations and balance between legitimate interest of the Data Controller and the rights and freedoms of the data subjects. Consequently, in absence of specific laws that provide for different storage periods, FABBRICA D'ARMI PIETRO BERETTA will make sure to use the data for the aforementioned marketing purposes for a period in line with the interest shown by the person to whom the data refers. In any case, FABBRICA D'ARMI PIETRO BERETTA will make sure to avoid using the data indefinitely. Periodically the Data Controller will verify the validity of the interest of the person to whom the data relates. Marketing activities can be carried out through traditional contact methods, such as regular mail and telephone calls with operator, or with automated contact methods, such as e-mail, SMS, MMS, fax and phone calls without operator.
3. Consent and consequences of refusal All personal data collected in the context of this processing, including through third parties, are collected exclusively to ensure the provision of the service by FABBRICA D'ARMI PIETRO BERETTA and the correct operation of the Shooting Data service. The collection of part of the data, such as those essential for identifying the user and address, is of obligatory nature for the correct functioning of the Shooting Data service. These data will be collected by the technical infrastructures installed at the contracted shooting fields (which act as independent data controllers) where the Shooting Data application may be used, which collects the shooting data and provides for the communication of the same to FABBRICA D’ARMI BERETTA. The failure to collect determines the impossibility for FABBRICA D'ARMI PIETRO BERETTA to guarantee the service to the user. Subject to your express consent, the addresses provided by you may be used to carry out marketing activities, as defined above; failure to consent to the processing of your data and contact details for the purposes indicated does not however prevent us from proceeding with the contractual relationship. Your contact details (address and e-mail), without prejudice to your right to refuse that you can exercise at any time, can be used to send promotional information relating to products and services of FABBRICA D'ARMI PIETRO BERETTA or other Beretta Group companies. As provided by the Privacy Authority the consent issued for the conduct of marketing activities with automated contact methods (such as text messages, mms, faxes, e-mails, web applications) also extends to traditional contact methods (regular mail or telephone call with operator). Similarly, the refusal to marketing activities with automated contact methods also extends to traditional contact methods. Your right to provide your consent or to exercise your right to refuse in relation to only one of the two methods of carrying out marketing activities remains unaffected. In all the cases mentioned above, the right of opposition may be exercised by you at any time by simply sending a message to the email@example.com mailbox or a written communication addressed to the Data Protection Office.
4.Persons authorised to process the personal data – Communication and disclosure of data The personal data collected are processed by the managers indicated below and by the staff in charge who needs to have knowledge of them in the performance of their activities. Your data will not be disclosed.

6. Rights of Data Subjects In reminding you that you have the right to file a complaint with a supervisory authority, please note that to exercise your rights (among which include the right of access to personal data, rectification or deletion of the same, limitation of processing, portability of personal data, opposition) - consistent with any regulatory and contractual obligations on the part of the Data Controller and/or the data subject - you can send a message to the e-mail address email@example.com or a written communication addressed to the Data Protection Manager of FABBRICA D'ARMI PIETRO BERETTA - Via Pietro Beretta n.18 CAP 25063, Gardone Val Trompia. In particular, we underline that the limitation of the processing that concerns you or the right to data portability concerns the processing carried out after May 25, 2018, date of application of the EU Privacy Regulation that introduces these rights. In addition, every data subject is always entitled to file a complaint with the Guarantor for the protection of personal data in the forms, ways and limits established by current legislation.
